Welcome to blu-kestrel.com (the “Site”), operated by BluKestrel Financial Planning (“BluKestrel,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Site, any services offered through the Site, and any related tools, portals, or communications provided by BluKestrel.

By accessing or using blu-kestrel.com, purchasing a financial planning service, or accessing the BluKestrel client portal, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site.

1. USE OF THE SITE

You may use the Site only for lawful purposes and in accordance with these Terms. You must be at least 18 years of age to use the Site or purchase financial planning services.

Your continued use of blu-kestrel.com constitutes acceptance of these Terms and any updates posted to the Site.

2. DESCRIPTION OF SERVICES

BluKestrel provides fee-only financial planning and investment guidance. BluKestrel does not provide discretionary investment management, does not execute trades, and does not take custody of client assets. Clients are solely responsible for implementing their own financial plans, including placing trades, opening accounts, choosing custodians, and managing their investments.

Our services may include, but are not limited to:

  • Comprehensive financial plans

  • Retirement and financial independence planning

  • Specialty or multi-topic planning packages

  • Investment analysis and guidance

  • Tax strategy considerations

  • Insurance and estate planning reviews

Services may be delivered as written reports, consultations, virtual meetings, or through the BluKestrel client portal. Delivery timelines referenced on blu-kestrel.com (such as 7–10 business days) are estimates and are not guaranteed.

A fiduciary relationship is established only after both parties sign a written engagement agreement outlining the scope and responsibilities of the engagement. BluKestrel’s services are offered only in jurisdictions where they may be lawfully provided and are subject to the terms of the applicable engagement agreement. Not all services described on blu-kestrel.com are available in all jurisdictions.

3. EDUCATIONAL CONTENT ONLY

All content on blu-kestrel.com and within the BluKestrel client portal, including articles, tools, calculators, projections, or illustrations, is provided for general informational and educational purposes only and does not constitute:

  • Personalized investment advice

  • Tax advice

  • Legal advice

  • A solicitation to buy or sell any financial product

Personalized guidance is provided only within a signed engagement. Nothing on blu-kestrel.com constitutes an offer or solicitation to buy or sell any security or financial product.

4. FEES, PAYMENTS AND REFUNDS

Fees for financial planning services are listed at the time of purchase and may change without notice.

  • Payments are due upfront unless otherwise stated.

  • Fees for custom engagements may vary.

  • Fees may be non-refundable once work has begun, or prorated based on work completed.

  • Additional services beyond the purchased package may require separate fees.

BluKestrel may decline or discontinue services for any reason; refunds will follow the applicable refund policy.

5. CLIENT RESPONSIBILITIES

Clients agree to:

  • Provide accurate and complete financial information.

  • Update BluKestrel if circumstances change.

  • Understand that planning outcomes rely on the information provided.

  • Implement their own planning recommendations independently.

6. LIMITATIONS OF LIABILITY

To the fullest extent permitted by law:

  • BluKestrel provides non-discretionary guidance only and does not monitor, manage, or review client accounts after delivering a financial plan. All investment decisions, trade execution, and account management remain solely the client’s responsibility.

  • Any investment-related information is non-discretionary guidance only; BluKestrel does not execute trades or monitor client accounts.

  • BluKestrel Financial Planning is not liable for financial losses, investment outcomes, tax consequences, or decisions made based on planning materials or Site content.

  • Use of the Site or planning tools is at your own risk. BluKestrel does not warrant that the content on blu-kestrel.com is accurate, complete, or current. Information may contain technical inaccuracies or typographical errors, and BluKestrel is under no obligation to update any content.

  • Past performance does not guarantee future results.

  • All services, tools, and materials provided through blu-kestrel.com are offered on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including but not limited to accuracy, completeness, fitness for a particular purpose, or suitability for your financial objectives.

  • BluKestrel is not responsible for service interruptions, inaccuracies, or third-party system failures.

7. NO FIDUCIARY DUTY FROM SITE USE

Browsing blu-kestrel.com or interacting with general content does not create a fiduciary relationship.
BluKestrel acts as a fiduciary only after a formal client engagement agreement is signed by both parties.

8. INTELLECTUAL PROPERTY

All content on blu-kestrel.com, including text, graphics, logos, images, service descriptions, and planning materials, are owned by BluKestrel Financial Planning and protected by applicable intellectual property laws.

No content may be copied, distributed, or reproduced without BluKestrel’s prior written consent.

9. USER ACCOUNTS AND CLIENT PORTAL

Access to the BluKestrel client portal requires creating an account through a secure third-party provider.

Users agree to:

  • Protect their login credentials

  • Notify BluKestrel of any unauthorized access

  • Use the portal solely for their personal financial planning

BluKestrel may suspend or terminate portal access at its discretion.

10. PRIVACY AND DATA PROTECTION

Your use of the Site is also governed by BluKestrel’s Privacy Policy, which explains how personal information is collected, stored, and used.

By using the Site, you consent to BluKestrel’s data practices as described in the Privacy Policy.

11. THIRD-PARTY SERVICES

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any disputes must be resolved in California courts.

14. CHANGES TO THESE TERMS

BluKestrel may update these Terms at any time. Updated Terms will be posted on blu-kestrel.com with a revised “Last Updated” date.

Continued use of blu-kestrel.com following the posting of revised Terms constitutes acceptance of the updated Terms.

15. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be severed from the Terms, and the remaining provisions will continue in full force and effect.
